1. INTRODUCTORY PROVISIONS

1.1 These General Terms and Conditions (hereinafter referred to as the “GTC”) apply to all reservations. Online bookings for accommodation services provided by the hotel operator, use of the hotel operator’s online reservation system, payment and cancellation conditions for online bookings made by client(s) via this website, as well as all other rights and obligations arising from the legal relationship established during an online reservation.

1.2 The client is entitled to use online reservations only if he or she agrees with the GTC. It is recommended, in the client’s own interest, to become acquainted with these GTC before making a reservation. When repeatedly using the online reservation, the client is always obliged to check the current version of the GTC. The hotel operator reserves the right to unilaterally amend these GTC, whereby the change becomes effective from the day of its publication on the hotel operator’s website. If the client does not agree with certain provisions of these GTC, the hotel operator requests that the online booking system not be used. By confirming the reservation, the client gives his unconditional consent to these GTC.

1.3 Each client acknowledges that all prices and conditions of reservation and provision of services apply exclusively to online reservations made via this website.

1.4 By using the online reservation system, the client declares that they have reached at least 18 years of age and have the legal capacity to acquire rights and assume obligations on their own behalf.

2. RESERVATION

2.1 With an online reservation, the client has the option to search for currently available accommodation capacities in the hotel according to the requirements specified in the reservation form (arrival date, departure date, room type, etc.).

2.2 During the online reservation, after selecting all necessary data for the start and end of the stay, room type, additional services, etc., the client fills in all required details.

2.3 After entering all required details, completing the payment as per these GTC, and after the information has been verified, a reservation confirmation including the reservation number will be immediately sent to the email address provided by the client. The assigned reservation number serves as confirmation of the reservation, as contact information for any changes or cancellation of the reservation, and as a check-in confirmation. For this reason, the client is obliged to keep the reservation number safe.

3. PAYMENT TERMS

3.1 Payment for the stay booked by the client in the online reservation must be paid in full during the online reservation using credit card payment services (eCard). For this reason, the eCard number of the payment/credit/debit card is required when booking online. By confirming the reservation, the client gives consent to payment for the booked stay in full in favour of the hotel operator (by withdrawing the stay price) and authorizes the hotel operator to execute this payment. The total price of the stay is immediately credited to the hotel operator's bank account.

3.2 The procedure and actions of the hotel operator are based on ethical principles and respect the client’s privacy. The reservation system currently uses state-of-the-art systems for encrypting sensitive data, which guarantees full security of the data provided by the client for payment.

3.3 The client authorizes the hotel operator to verify the details of the credit/debit card provided at the relevant bank's or card issuer’s call center.

4. CANCELLATION TERMS

4.1 Any changes to an online reservation by the client can be made electronically after entering the client’s email address provided at booking and the reservation number assigned and sent to the client upon booking, or in writing, by phone, or by email through the reservation department of the hotel operator at phone: +421 918 980 084, email: villanecas@villanecas.sk. For changes to an online reservation, the client must always provide the reservation number assigned to the online reservation and sent to the email provided at the time of booking. If the client requests a change to the booking that cannot be accommodated due to capacity or operational reasons, the operator will make every effort to meet their requirements, though the hotel operator is not obliged to do so, and the client is not entitled to compensation or any other performance from the operator for the inability to change the existing reservation.

4.2 In case the client cancels the contract and the reservation, the hotel operator is entitled to a cancellation fee as follows:

75% of the price of ordered and confirmed services 6 – 2 days before check-in
100% of the price of ordered and confirmed services from 1 day and the day of arrival

4.3 In the case of no-show, the hotel operator is entitled to a cancellation fee of 100% of the price of ordered and confirmed services.

4.4 In case of withdrawal from the contract and cancellation of the reservation, or partial withdrawal and partial cancellation, or no-show for promotional stays (Art. 6 of GTC), the hotel operator is entitled to a cancellation fee of 100% of the price of ordered and confirmed services.

4.5 In case of withdrawal and cancellation, or partial withdrawal and partial cancellation, or no-show in extraordinary cases (illness, death, disaster, etc.), the hotel operator is entitled to waive the cancellation fee upon submission of reliable proof of a serious reason for withdrawal and cancellation or partial withdrawal and cancellation, or no-show.

4.6 In case of withdrawal and cancellation or partial withdrawal/partial cancellation or no-show, the hotel operator will notify the client in writing or by email of the assertion and amount of the cancellation fee within 14 days from the withdrawal/cancellation, partial withdrawal/cancellation, or from the check-in date in case of no-show. By confirming the order and agreeing with these GTC, the client acknowledges and agrees that the hotel operator is entitled in the above cases to offset the client’s claim for a refund against the operator’s claim for the cancellation fee to the extent these claims cover each other; any remaining sum in favor of the client will be refunded via a bank transfer to the account from which the payment was made during the online reservation, within 30 working days after the day following the withdrawal and cancellation, partial withdrawal/cancellation or no-show. All bank charges related to returning the price of the stay are borne by the client.

5. SPECIAL PROVISIONS

5.1 In case of any ambiguities or questions arising in connection with online reservations, the client may contact the reservation department of the hotel operator by phone: +421 918 980 084 or by email: villanecas@villanecas.sk

5.2 Check-in is possible on the first day of the stay per the reservation from 14:00. Check-out on the last day of the stay per the reservation is until 10:00.

5.3 In case of special requests (crib, late arrival or departure, or booking additional services), the client may contact the hotel’s reservation department by email: villanecas@villanecas.sk.

6. PROMOTIONAL STAYS

6.1 The hotel operator is entitled to offer promotional stays (last minute, first minute, etc.). The number of rooms for promotional stays is limited.

6.2 Special terms and conditions apply exclusively to the booking and implementation of promotional stays, and these have priority over the GTC. The GTC apply to promotional stays only in areas not otherwise regulated by the special conditions.

7. PROTECTION OF PERSONAL DATA

7.1 The hotel operator processes freely provided personal data of the client to the extent provided in the reservation form, i.e.: name, surname, address, country of residence, email, phone number, as processing this data is necessary for the reservation of accommodation services provided by the hotel operator and/or for fulfilling client requests for information before services are provided, and for the hotel operator’s legal obligations. Processing is carried out for the period necessary to accomplish the purposes stated above.

7.2 The client may check the relevant box prior to submitting the reservation to express consent to receiving newsletters and special offers (newsletter). By checking the box, the client, as a data subject, grants voluntarily and expressly, in accordance with data protection law and EU regulations, consent to process the provided email for marketing purposes – sending newsletters via email. This consent is given for a period of 5 years.

7.3 The client is responsible for the completeness, truthfulness, and correctness of provided personal data. In the case of any changes, the client is obliged to inform the hotel operator without delay.

7.4 Consent for personal data processing for marketing purposes (receiving newsletters) may be revoked at any time by clicking the respective link in any marketing email from the hotel operator or by emailing villanecas@villanecas.sk.

7.5 In the case of outdated data, revocation of consent, accomplishment or expiration of the period for which consent was given, or if storage is illegal, stored data will be deleted.

7.6 Data protection is governed by the law on personal data protection and relevant EU legislation, where the client’s rights as a data subject are also regulated. The client is entitled to free information regarding the processing of their stored data. Provided legal requirements are observed, the client also has (i) a right of access to their personal data, (ii) a right to rectification of incorrect data, (iii) a right to restriction (blocking) of processing, (iv) a right to object to processing for direct marketing, (v) a right to erasure, especially if data is no longer needed for the purpose it was collected or processed, or if consent is revoked and there is no other legal basis for processing, or if data was processed unlawfully. Under stipulated conditions, the client also has the right to data portability, i.e., to obtain personal data voluntarily provided in electronic form, in a structured, commonly used, and machine-readable format, and to transmit this data to another operator, provided such transfer is technically possible (right to data portability).

7.7 If a client exercises data subject rights with the hotel operator and the identity of the requester cannot be verified from the application or if the hotel operator has reasonable doubts as to the identity of the person making the request, the hotel operator reserves the right to request additional information necessary for confirmation.

7.8 As a data subject, the client has the right to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection of the Slovak Republic, Hraničná 12, 820 07 Bratislava, if they suspect that their personal data is being processed unlawfully.

7.9 The hotel operator declares that it processes personal data only for the above purposes and in accordance with the law on data protection and relevant EU legislation, using appropriate technical, organizational, and security measures.

7.10 The client's personal data may, to the necessary extent, be provided to contractual service providers of the hotel operator (other third-party recipients), if this is necessary for the purpose for which it was collected. Such contractual service providers include especially marketing service providers, banks, etc. Data may only be used by these providers for the purpose for which it was collected.

8. FINAL PROVISIONS

8.1 These GTC and the legal relationships arising on their basis are governed by the legal order of the Slovak Republic.

8.2 If any provision of these GTC is or becomes invalid, ineffective or unenforceable, such invalidity, ineffectiveness or unenforceability does not affect the remaining provisions of these GTC.

8.3 By confirming the online reservation, the client expresses agreement with these GTC and undertakes to comply. The hotel operator reserves the right to change these GTC. The obligation of written notification of changes to the GTC is fulfilled by posting the amended GTC on the operator’s website www.villanecas.sk

8.4 These GTC come into validity and effect on 05.06.2025
